
In connection with the publication of UniCredit’s report containing information which was defamatory for our company and which has had a negative effect on the financial interests of Grupa LOTOS and its shareholders, we decided to take legal action with a view to protecting the rights of Grupa LOTOS and its shareholders.
In connection with the publication of UniCredit’s report containing information which was defamatory for our company and which has had a negative effect on the financial interests of Grupa LOTOS and its shareholders, we decided to take legal action with a view to protecting the rights of Grupa LOTOS and its shareholders.
Grupa LOTOS notified the Polish Financial Supervision Authority of action bearing the attributes of an unreliable recommendation to buy/sell shares. The FSA initiated relevant proceedings. Similar applications were filed with the Financial Services Authority in the UK and with BaFin (Bundesanstalt für Finanzdienstleistungsaufsicht) in Germany.
Given the fact that Grupa LOTOS is an entity of strategic importance for the Polish economy, the management of Grupa LOTOS fears that steps could have been taken with a view to introducing permanent ownership changes in the entire Polish fuel sector. Therefore, the management of Grupa LOTOS requested the Chairman of the National Energy Security Committee (and Poland’s prime minister) to take expedient steps.
Concurrently, the management of Grupa LOTOS intends to file a suit seeking protection of the company’s good name and financial interests. Grupa LOTOS has obtained expert opinions indicating that UniCredit’s analysis was unreliable and the conclusions presented in its report – incorrect. Additionally, Grupa LOTOS obtained legal opinions stating it had the possibility to assert its rights in court.
